In this paper, I present a new (i.e., previously overlooked) breed of exercitive speech act (the conversational exercitive). I establish that any conversational contribution that invokes a rule of accommodation changes the bounds of conversational permissibility and is therefore an (indirect) exercitive speech act. Such utterances enact permissibility facts without expressing the content of such facts, without the speaker intending to be enacting such facts and without the hearer recognizing that it is so. Because of the peculiar nature ofthe rules (...) of accommodation that generate them, conversational exercitives have importantly different felicity conditions and therefore constitute a new breed ofexercitive speech act. ABSTRACT This paper argues for a hidden way in which speech constitutes harm by enacting harmful norms. The paper then explores the potential legal consequences of uncovering such instances of harm constitution. In particular, the paper argues that some public racist speech constitutes harm and is thus harmful enough to warrant legal remedy. Such utterances are actionable, it is contended, because they enact discriminatory norms in public spaces.

Are ecosystems morally considerable-that is, do we owe it to them to protect their “interests”? Many environmental ethicists, impressed by the way that individual nonsentient organisms such as plants tenaciously pursue their own biological goals, have concluded that we should extend moral considerability far enough to include such organisms. There is a pitfall in the ecosystem-to-organism analogy, however. We must distinguish a system’s genuine goals from the incidental effects, or byproducts, of the behavior of that system’s parts. Goals seem capable (...) of giving rise to interests; byproducts do not. It is hard to see how whole ecosystems can be genuinely goal-directed unless group selection occurs at the community level. Currently, mainstream ecological and evolutionary theory is individualistic. From such a theory it follows that the apparent goals of ecosystems are mere byproducts and, as such, cannot ground moral considerability. (shrink)

We all know that speech can be harmful. But how? Mary Kate McGowan argues that speech constitutes harm when it enacts a norm that prescribes that harm. She investigates such harms as oppression, subordination, and discrimination in such forms of speech as sexist remarks, racist hate speech, pornography, verbal triggers, and micro-aggressions.

The great political ideas and movements of the modern world were founded on a promise of universal emancipation. But in recent decades, much of the Left has grown suspicious of such aspirations. Critics see the invocation of universality as a form of domination or a way of speaking for others, and have come to favor a politics of particularism—often derided as “identity politics.” Others, both centrists and conservatives, associate universalism with twentieth-century totalitarianism and hold that it is bound to lead (...) to catastrophe. This book develops a new conception of universality that helps us rethink political thought and action. Todd McGowan argues that universals such as equality and freedom are not imposed on us. They emerge from our shared experience of their absence and our struggle to attain them. Suppose a diner says, 'Can you pass the salt?' Although her utterance is literally a question (about the physical abilities of the addressee), most would take it as a request (that the addressee pass the salt). In such a case, the request is performed indirectly by way of directly asking a question. Accordingly this utterance is known as an indirect speech act. On the standard account of such speech acts, a single utterance constitutes two distinct speech acts. On this account (...) then, 'Can you pass the salt?' is both a question and a request. In a provocative essay, Rod Bertolet argues that there are no indirect speech acts. According to Bertolet, 'Can you pass the salt?' is only a question. It is a question that merely functions as a request (without also being one). In this paper we respond to Bertolet's skeptical argument. Appealing to Searle's theory of speech acts and to certain features of linguistic communication, we argue that, despite Bertolet's challenge, there is good reason to countenance indirect speech acts. Beyond impressionistic observations, little is known about the role and influence of scientific societies on research conduct. Acknowledging that the influence of scientific societies is not easily disentangled from other factors that shape norms and practices, this article addresses how best to study the promotion of research integrity generally as well as the role and impact of scientific societies as part of that process. In setting forth the parameters of a research agenda, the article addresses four issues: (1) how to (...) conceptualize research on scientific societies and research integrity; (2) challenges and complexities in undertaking basic research; (3) strategies for undertaking basic research that is attentive to individual, situational, organizational, and environmental levels of analysis; and (4) the need for evaluation research as integral to programmatic change and to assessment of the impact of activities by scientific societies. This article explores the emergence of leadership during implementation of a water saving initiative in the rural community surrounding Barren Box Swamp in the Murray Darling Basin, Australia. Qualitative data analysis indicated that the system elements affecting the type of leadership to emerge included the extent to which the groups were engaged in the process, the level of access to resources, and the level of investment in the outcomes of the project. Although these results reinforced key aspects of complex problem-solving (...) through collaboration, they demonstrated varying degrees and types of both engagement and leadership within the case community. Given the current finding that these varying elements can coincide within one system, this case suggests that each community’s characteristics, resources and context will determine the optimal combination of leadership style and level of collaboration needed to facilitate sustainable community development. This article investigates the place of trust in learning relations in the classroom, not only between teacher and student, but also between student and student. To do this, it will first examine a pedagogy called community of inquiry, espoused by John Dewey and used in most Philosophy for Children courses in Australia. It will then consider what different forms of trust are involved in other power relations in the classroom, particularly the rational structuralism of R.S Peters, or the experiential philosophy (...) of Maria Montessori. It concludes that a community of inquiry shifts the ethical learning relation in significantly different ways because for educational growth, it values ethical trust more highly than a strategic trust in logical principle, duty, Truth, or cost/benefit analysis. Pp. xxi, 177· US$19.95; paper $9·95· B rian Hendley's book is more than a well-written account of three eminent philosophers who wrote about and participated in educational theory (...) and reform. The author has in fact selected Dewey, Russell and Whitehead as three stallions to draw a chariot. The precise nature of this "chariot" is indicated in the chapter entitled "The Philosopher as Educator Today" appearing at the end of the book: My intention throughout has been to suggest a way out of the current impasse in the philosophy ofeducation by reopening a conversation regarding a more productive role for philosophers to play, rather than merely analyzing concepts and policing arguments. My claim has been that philosophers of education can learn from their past, that we can see in Dewey, Russell and Whitehead instances of a productive approach to educational problems through thought and action. (P. 105) Having said this, the structure and contents of Hendley's book fall squarely into place. Chapter One, entitled "The Reconstruction of the Philosophy of Education", argues that there is a crisis in the current state of educational philosophy. The ensuing three chapters are devoted individually to Dewey, Russell and Whitehead. The concluding chapter, resting upon the strength of the examples given of three constructive contributors to the field, suggests new directions for the philosophy of education. It is clear that Hendley's book is more than an interesting account of the practical and theoretical educational activities of three of the most influential philosophers of the twentieth century. Dewey, Russell and Whitehead are not gathered together between the. same covers in order to explore or present a detailed analysis of their theoretical similarities or who may have influenced Reviews 219 whom. Instead, one gathers that the author has selected them on the basis of his own admiration and preference rather than for any shared theories which connect them. The point is made, however, that the strongest common element, and the most significant one, is that each man had ideas about education, each was a philosopher, and each attempted to exert some practical influence upon the educational institutions and practices of the day. In short, Dewey, Russell and Whitehead were theorists who were prepared to get their hands dirty. Hendley argues that after the death of John Dewey in 1952 educational philosophy was neglected and· philosophers tended to pay less attention to education. The author goes on to suggest some renewed interest in the field on the grounds of contributions made to the fifty-fourth Yearbook of the National Society for the Study of Education in 1955 under the theme "Modern Philosophies and Education", a special issue of the Harvard Education Review published in 1956; the publication of Israel Scheffler's edited collection of readings entitled Philosophy and Education in 1958; and R. S. Peters' Inaugural Address given at London in 1963, and his publication of Ethics and Education in 1966. According to this argument, we witness a general lapse after the death of Dewey, a rekindling in the mid-1950S and a broader resurgence in the 1960s. On the basis of the author's own account, I think that it is very difficult to argue that Dewey's death initiated any period of calm or disinterestedness. Furthermore, it is very problematic to point to various yearbooks or publications as indicators. The point is that with the death of Dewey there were numerous contenders to fill his position as the pre-eminent American philosopher of education. The extent to which anyone has been able to do so is a different matter. What I believe Hendley is really trying to say here is implicit in his argument, namely, that after the death of Dewey, no philosopher of equal stature took his place. This article investigates how the turn to affect within the humanities and social sciences re-imagines the relationship between cultural theory and science. We focus on how the writings of two neuroscientists (Antonio Damasio and Joseph LeDoux) and one developmental psychologist (Daniel Stern) are used in order to ground certain claims about affect within cultural theory. We examine the motifs at play in cultural theories of affect, the models of (neuro)biology with which they work, and some fascinating missteps characterizing the taking (...) up of scientific literature. While neuroscience frames the affective as part of a system of regulation that makes both self and social coherence possible, in cultural theory’s narratives, by contrast, affectivity becomes a placeholder for the inherent dynamism and mutability of matter. The article interrogates the consequences of cultural theory’s strange borrowings from neuroscience and developmental psychology in their institution of a model of subjectivity preoccupied with a lived present in excess of the hold of habit and embodied history. The ever-increasing prevalence of chronic conditions over the last half century has gradually altered the demographic of patients admitted to acute care settings; environments traditionally associated with episodic care rather than chronic and complex healthcare. In consequence, the lifeworld of the hospital medical doctor often entails healthcare for a complex, multi-morbid, patient cohort. This paper examines the experience of providing complex healthcare in the pressurised and fast-paced acute care setting. Four medical doctors from two metropolitan health services were interviewed and (...) their data were analysed using a combinatorial framework of phenomenology and complexity theory. The horizon of complex care revealed itself as dynamic, expansive, immersive, and relational, entailing a specialised kind of practice that is now common in acute care settings. Yet this practice has made inroads largely without heralding the unique nature and potential of its ground. Herein lies opportunity for complex care clinicians to expand notions of health and illness, and to shape research, practice, and system design, for a future in which care for health complexity is optimised, irrespective of care settings. The Problem of Consciousness This chapter will introduce you to consciousness and its most important characteristics. We will look at definitions of consciousness, and examine what it means to say that consciousness is a private experience. We will look at the idea that it is like something to be you or me. The chapter mentions ideas and themes that will be covered in more detail in the rest of the book, and explains why the topic is an important one. Research (...) on consciousness is big on questions but shorter on answers. Nevertheless these questions are central to what it means to be human, or indeed at the heart of what it's like to be anything - what it's like to be conscious. Think of yourself just now. What does it feel like you to be you right at this moment? Think of a loved one. What do you think it is like to be them? Do they know exactly what they're feeling, and do you know just what they're feeling? We might have some idea, but the answer in both cases is no, and not only "no", we can't see how we ever could know for sure. It's my consciousness and your consciousness. (shrink)

Marshall's article used Wittgenstein to argue that self functions as an explanation for a name rather than a referent. This brief response tries to rescue Marshall from an apparent reduction of self to material body without returning him to the mind/body dualism that he, with Wittgenstein and Dennett, seeks to avoid. It treats ‘I’ as an emergent institutional fact, not inconsistent with a constructed explanation or narrative, but emerging from shared social practices rather than an abstracted agent.

I here present two different models of oppressive speech. My interest is not in how speech can cause oppression, but in how speech can actually be an act of oppression. As we shall see, a particular type of speech act, the exercitive, enacts permissibility facts. Since oppressive speech enacts permissibility facts that oppress, speech must be exercitive in order for it to be an act of oppression. In what follows, I distinguish between two sorts of exercitive speech acts (the standard (...) exercitive and the covert exercitive) and I argue that each such exercitive affords a distinct model of oppressive speech.
